A bylaw to appoint municipal law enforcement officers

Whereas Section 15(1) of the Police Services Act, R.S.O. 1990, Chapter P.15
provides that a municipal council may appoint persons to enforce the bylaws of the municipality;

And whereas Section 15(2) of the Police Services Act, R.S.O. 1990, Chapter P.15, provides that municipal bylaw enforcement officers are peace officers for the purpose of enforcing municipal bylaws;

And whereas the Council of The Corporation of the City of Waterloo deems it expedient to appoint municipal law enforcement officers to enforce the bylaws of the municipality;

Now therefore the council of the corporation of the City of Waterloo enacts as follows. 


1.0 Municipal law enforcement officer appointments 

The persons named in the attached Schedule “B” are hereby appointed Municipal Law Enforcement Officers for the purpose of enforcing certain bylaws of the City, as set out in Schedule “B”.

The persons named in the attached Schedule “B” shall remain Municipal Law Enforcement Officers until their appointment is rescinded by bylaw.

The persons named in the attached Schedule “C” are hereby appointed Municipal Law Enforcement Officers for the purpose of enforcing certain bylaws of the City, as set out in Schedule “C”, on the property of the University of Waterloo.

The persons named in the attached Schedule “C” shall remain Municipal Law Enforcement Officers until their appointment is rescinded by bylaw.

The persons named in the attached Schedule “D” are hereby appointed Municipal Law Enforcement Officers for the purpose of enforcing certain bylaws of the City, as set out in Schedule “D”, on the property of the Wilfrid Laurier University.

The persons named in the attached Schedule “D” shall remain Municipal Law Enforcement Officers until their appointment is rescinded by bylaw.


2.0 Severability 

If a Court of competent jurisdiction should declare any section or part of a section of this bylaw to be invalid, such section or part of a section shall not be construed as having persuaded or influenced Council to pass the remainder of this bylaw and it is hereby declared that the remainder of this bylaw shall be valid and shall remain in full force and effect.


3.0 Repeal 

All previous bylaws enacted by the City appointing Municipal Law Enforcement Officers, and any portions of the Municipal Code relating to the appointment of Municipal Law Enforcement Officers, are hereby repealed.


4.0 Coming into force 

This bylaw shall come into force on the date of its passage by Council.
