A bylaw to appoint City of Waterloo employees as municipal law enforcement officers. 

Whereas section 15 of the Police Services Act, R.S.O. 1990, c. P-15 provides that a municipality may appoint persons to enforce the bylaws of the municipality and that Municipal Law Enforcement Officers are peace officers for the purpose of enforcing municipal bylaws;

And whereas The Corporation of the City of Waterloo is desirous to appoint certain employees as Municipal Law Enforcement Officers;

Now therefore the Council of The Corporation of the City of Waterloo enacts as follows:


1. In this Bylaw, the following terms shall have the corresponding meaning:

“Bylaw” means a bylaw that is enacted by the Council of The Corporation of the City of Waterloo, and “Bylaws” shall have the same meaning but in the plural form;

“City” means The Corporation of the City of Waterloo.


 2. Notwithstanding all other sections of this Bylaw, those persons who are  employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing all Bylaws.  These employees work in Protective Services, Bylaw Enforcement   Division:

a) Director, Bylaw Enforcement

b) Manager, Licensing and Standards

c) Supervisor, Compliance and Standards

d) Compliance and Standards Officer

e) Licensing and Standards Officer

f) Parking Enforcement Officer

g) Bylaw Enforcement Assistant

h) Snow and Ice Inspector.


3. Notwithstanding all other sections of this Bylaw, those persons who are employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing all Bylaws.  These employees work in Protective Services, Fire and Community Relations Divisions:

a) Fire Chief

b) Deputy Chief Operations

c) Deputy Chief Administration & CEMC

d) Public Education Officer

e) Chief Fire Prevention Officer

f) Captain Fire Prevention Officer

g) Fire Prevention Officer

(h) Manager, Community Relations


4. Those persons who are employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing the Licensing Bylaw 02-185 as may be amended from time to time; Animal Control Bylaw 09-047 as may be amended from time to time; and Outdoor Vending Bylaw 02-190, as may be amended from time to time. These employees work in Corporate Services, Clerks/Corporate Secretary Division:

a) Licensing Officer

b) Licensing Clerk


 5. Those persons who are employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing the Licensing Bylaw 02-185 as may be amended from time to time; Animal Control Bylaw 09-047 as may be amended from time to time; and Outdoor Vending Bylaw 02-190, as may be amended from time to time. These employees work in Corporate Services, Clerks/Corporate Secretary Division:

a) Licensing Officer

b) Licensing Clerk


6. Those persons who are employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing the Backflow Prevention Bylaw 2010-040,  as may be amended from time to time; and the Supply of Water Bylaw 08-123, as may be amended from time to time.  These employees work in Development Services, Building Standards Division:

a) Backflow Prevention Officer.


 7. Those persons who are employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing the Backflow Prevention Bylaw 2010-040,  as may be amended from time to time; and the Supply of Water Bylaw 08-123, as may be amended from time to time.  These employees work in Development Services, Building Standards Division:

a) Backflow Prevention Officer.


 8. Those persons who are employed by the City to perform the duties of the following positions are hereby appointed as Municipal Law Enforcement Officers for the purpose of enforcing the Private Property Bylaw 08-092 (also known as 4009), as may be amended from time to time; the Disabled Bylaw 09-106, as may be amended from time to time; and the Fire Route Bylaw 78-34, as amended from time to time.  These employees work in Public Works Services, Parks Operations- Waterloo Park:

a) Manager, Parks Services.
