Get a backyard pool or hot tub enclosure permit

You must have an enclosure permit before filling a new or replacement backyard pool or hot tub.

An enclosure is a fence, wall or deck surround that restricts access for safety.

1. Check if you need a permit

You need an enclosure permit before filling a pool or hot tub with water. This is required under the Pool Enclosure Bylaw to keep your yard safe.

An enclosure is a fence, wall or deck surround that restricts access for safety. 

You need a pool or hot tub enclosure permit when you:

  • install a new pool or hot tub
  • replace or alter an existing enclosure

Hot tubs and swim spas with lockable lids

You still need a permit, but there’s no fee, if your hot tub or swim spa has a lockable lid that meets ASTM Standard F1346-91. 

The lid must stay locked when the hot tub or swim spa is not in use.


2. Prepare your drawings

Include:

  • a site plan showing pool/hot tub location, property lines, buildings, and enclosure placement
  • a cross-section of the fence showing materials, dimensions, and gate type
  • gate details including swing direction, latching, and height

Example drawings

You can use a survey or hand-drawn plan, but it must show all measurements for property lines, fences, buildings, and the pool or hot tub.


3. Complete the application

Download and complete the pool enclosure permit application (PDF)

  • if you are not the property owner, include written approval from the owner
  • bring your application, drawings and payment to City Hall

4. Pay the fee

The fee is $265.66 (HST is included) for pools and hot tubs without lockable lids.

There is no fee for hot tubs with qualifying lockable lids.


5. Book inspection

Once your enclosure is built, but before filling the pool or hot tub call 519-747-8785 or email municipalenforcement@waterloo.ca to book an inspection.


6. Fill your pool or hot tub

Once your enclosure passes inspection, you may fill the pool or hot tub. Keep a copy of your permit and inspection record for your files.


7. Draining your pool or hot tub

When it’s time to empty your pool or hot tub, follow our safe draining guidelines to protect waterways and meet local bylaws.
